Terms of Service
The agreement between you and MissingLayer B.V. for using Our Little Place.
Pre-publication draft: these terms must be reconciled with the final app, store listings and deletion lifecycle, then approved before the app is made public.
In one paragraph
Our Little Place is a private space for two adults in a relationship. Use it lawfully and kindly. It is a young app provided as-is, without a guarantee of availability, and its encryption has not been independently audited. You can leave at any time by unpairing and requesting erasure of your service account.
1. Who these terms are with
These terms are an agreement between you and MissingLayer B.V., Korte Lijnbaanssteeg 1/4570, 1012 SL Amsterdam, Netherlands, KVK 97964840 ("we", "us"). They cover your use of the Our Little Place mobile app and this website. Our Privacy Policy explains how the service handles personal data.
Apple App Store. Unless we publish a custom licence in App Store Connect, Apple's Standard End User License Agreement supplies your licence to use the iOS app. These terms are additional terms between you and us; Apple's Standard EULA governs if the two conflict on the licence itself.
Google Play. For the Android app, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use Our Little Place on devices you own or control for lawful, personal, non-commercial use, subject to these terms and Google Play's terms.
2. Using Our Little Place
- You must be 18 or older and able to enter into a contract.
- The app is built for exactly two people. Each account pairs with one partner and has one shared conversation.
- You are responsible for the device you use, for keeping it secure with a screen lock, and for the people you allow to use that device.
- You agree to follow these terms and any rules shown in the app.
3. Your account and pairing
- The app assigns your installation a pseudonymous service account. You do not provide a username, email address, phone number or password.
- Access depends on your device and the keys stored on it. If you lose the device or delete the app without a paired partner able to help you re-pair, that history cannot be recovered by us.
- Pairing requires both people to confirm the same verification phrase. Unpairing takes effect on both sides and cannot be undone by reusing an old code.
4. Acceptable use
Your messages and media are end-to-end encrypted, so we cannot and do not monitor their content. That does not make the following acceptable. You agree not to use Our Little Place to:
- break the law, or help anyone else do so;
- harass, threaten, stalk, impersonate or abuse another person, including your partner;
- create, request or share material that sexually exploits or endangers a child;
- share content you have no right to share, or that infringes someone else's rights;
- probe, attack or try to circumvent the security of the app or our systems, or use the service to distribute malware;
- copy, modify, decompile or reverse engineer the app, except to the extent applicable law expressly permits;
- use automated means to access the service, or resell or commercialise it.
Where we can identify serious abuse from a report or from metadata, we may suspend or terminate the accounts involved and, where the law requires it, cooperate with the authorities. To report illegal content or misuse, email [email protected] with enough information for us to identify the account or encrypted object and understand the reason for the report. Because content is end-to-end encrypted, we may need the reporting user to provide the material they want us to assess.
5. Your content
Each of you keeps ownership of the content you create in Our Little Place. We claim no ownership of it. We and our licensors keep the rights in the app, website, product name, artwork, interface and code.
You grant us only the limited licence needed to operate the service: to store and transmit encrypted data between the paired installations and our providers, and to keep the technical records described in the Privacy Policy. The retention and deletion section explains the current development limitations and when this licence ends.
6. The service is provided "as is"
- Our Little Place is a young product still under active development. Features may change, be added or be removed.
- We do our best to keep it available and reliable, but we do not guarantee uninterrupted or error-free operation, and messages or calls may occasionally be delayed or fail.
- It is not a service for emergencies. Do not rely on it to contact emergency services.
- The cryptography has not had an independent audit. Please read section 10 of the Privacy Policy for exactly what is and isn't protected, and do not treat the app as equivalent to an audited messenger.
- To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
7. Third-party services
Our Little Place is distributed through the Apple App Store and Google Play and relies on Supabase, Google services for push notifications and maps, and a LiveKit call relay we run on Microsoft Azure. Your use of those parts is also subject to the relevant provider's terms. You must comply with applicable third-party terms, including the terms of your network provider. We remain responsible for our own obligations and for selecting and instructing processors where data-protection law requires it.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, messages or media, arising from your use of the service or from your device, network, misuse of the app or a third-party service.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or your mandatory rights as a consumer.
9. Suspension and termination
You can stop using the service at any time by unpairing and removing the app. To request erasure of the pseudonymous service account and backend data, follow the process in the Privacy Policy. We may suspend or end access if you materially breach these terms, if law requires it, or if we discontinue the service. Where reasonable and lawful, we will give notice. Sections that by their nature should survive termination (including content rights, disclaimers, liability and governing law) continue to apply.
10. Changes to these terms
We may update these terms as the service changes. We will change the date above and give reasonable notice of material changes in the app or on this page. Where applicable law requires your agreement to a change, we will ask for it. Otherwise, if you do not agree with revised terms, stop using the app and unpair before they take effect.
11. Governing law and disputes
These terms are governed by the law of the Netherlands. If you are a consumer, you also keep the protection of any mandatory consumer-law provisions of the country where you live. Disputes may be brought before the competent courts of Amsterdam, the Netherlands, without affecting your right as a consumer to bring proceedings in your own country.
